Officials for The Quigley Corporation Respond to News Reports about Nasal Spray Lawsuit
DOYLESTOWN, PA. - November 5, 2004 - The Quigley Corporation (Nasdaq: QGLY)
In response to news reports citing a lawsuit filed in Bucks County, PA,
yesterday by eight consumers who are taking legal action against The Quigley
Corporation, manufacturers of its zinc gluconate nasal spray, company officials
said they had no knowledge of the lawsuit until a faxed complaint was received
at 2:15 PM EST on November 5, 2004. The company has yet to be officially
served and upon a cursory look at the faxed documents, the company considers
the suit to be frivolous and without merit and will defend it vigorously. The
company reaffirmed the safety of its Nasal Spray due to completion of clinical
safety studies conducted prior to retail introduction in September of 2003.
"Quigley conducts thorough clinical trials on all its products before
introducing them to the marketplace. Accordingly, we conducted a double-blind,
placebo-controlled study to evaluate the safety of the nasal spray. Subjects
receiving three days of treatment with intranasal zinc did not demonstrate a
diminished sense of smell," said Guy Quigley, president and CEO of The Quigley
Corporation.
Any nasal product, including saline spray, might cause a person to experience
irritation. Additionally, consumers may incorrectly attribute a nasal spray
for the onset of a symptom, which should instead be attributed to a
pre-existing condition, such as a sinus infection. The list of conditions that
have been documented to cause a loss of smell is extensive, with the most
common being head injury, upper respiratory infection and nasal and sinus
disease.
